RESOLUTION NO. 18-93 <br />A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF COMMISSIONERS, <br />COOK COUNTY BOARD OF APPEALS, AND THE COUNTY CLERK FOR TRANSMITTAL <br />TO COOK COUNTY BOARD OF COMMISSIONERS IN RESPONSE TO THE PUBLIC <br />HEARING HELD BY THE COOK COUNTY BOARD OF APPEALS ON MARCH 5, 1993 <br />REGARDING THE REZONING OF PROPERTY LOCATED ON THE SOUTH SIDE OF <br />HIGGINS ROAD APPROXIMATELY 153.7 FEET WEST OF STANLEY AVENUE <br />WHEREAS, the applicant, G. Gaffney, Attorney, on behalf of the owner, <br />T. & B. Pecera, of the property legally described as follows: <br />Part of the West 1/2 of the Southwest 1/4 of Section 22, <br />Township 41 North, Range 11 with a point of beginning 36.82 feet <br />south of the intersection of the West line of said Southwest 1/4 <br />w/centerline, by deed, of Higgins Road, thence southeasterly <br />232.12 feet, thence south 913.05 feet, thence west 230 feet, <br />thence north 947.64 feet to the point of beginning, East of the <br />Third Principal Meridian (the "Subject Property") <br />has petitioned for a map amendment to rezone from R-5 Single Family <br />Residential District to C-8 Intensive Commercial District for office/ <br />warehouse; and, <br />WHEREAS, said case has been docketed as Docket Number 5908 by the Cook <br />County Zoning Board of Appeals: and <br />WHEREAS, the Village of Elk Grove Village is contiguous to this <br />property on the North, West and South sides. <br />NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees <br />of the Village of Elk Grove Village, Counties of Cook and DuPage, State of <br />Illinois as follows: <br />Section 1: That the Village of Elk Grove Village does hereby <br />register objection to the petitioner's request for the rezonino of the <br />Subject Property described above for the following reasons: <br />a. The parcel of property is outside the corporate limits of <br />Elk Grove Village and, therefore, will net receive sanitary <br />sewer or water service from the Vil a'f qe of Elk Grove. It is <br />doubtful that the proposed use can be accomodated by an <br />individual sewage disposal system and water supply system. <br />b. Initial emergency Fire services in this area are <br />provided by the Village of Elk Grove Village. The <br />increased intensity of personnel and type of building <br />construction which will be created by the proposed rezoning <br />will place additional emergency service burdens <br />upon the Village. <br />c. The permitted uses in the C-8 Intensive Commercial <br />District are incompatible with the existing Residential <br />land uses surrounding the property. The requested <br />rezoning would amount to spot zoning and would be <br />detrimental to surrounding property. <br />d. The Village's Comprehensive Plan dated April 24,1990 adopted <br />by Ordinance No.2100 attached hereto asiMii{a-"` <br />identifies the future zoning of this property, if annexed to <br />the Village, as R-3 Residential. <br />
